Pool ‘whipping boy’ resigns

Tauranga City Aquatics Limited director, Deputy Mayor David Stewart, has resigned from the board, saying his position has become untenable.

He was appointed a TCAL director by the Tauranga City Council in August 2009 and since then has found himself the 'whipping boy” caught in the middle.


The appointment was at the time said to be able to provide the TCAL board with possible ‘valuable input' in dealing with local government.

Instead, David says his role as a shareholder representative excluded him from aquatic related debate on the board and with the council.

'On the one hand with TCAL it provided some difficulties with the perception that I was representing council's interests on their board, and then going the other way when it came to discussing or debating aquatic strategies and needs, and that sort of thing, there was a perception that I had a conflict of interest or indeed that I was advocating for TCAL,” says David.

In discussion with councillors it was generally agreed that as a council appointee, there was no conflict and David was not excluded from aquatic discussions.

'But nevertheless when it comes to debate sometimes that's thrown up in the air, and I can see there can be a perception that there is a conflict of interest which keeps me out of debate.

'Really the last straw came when we were debating the moveable floor for Baywave, and there is the allegation that I'm advocating for TCAL's interests, so I thought enough is enough.”

What should have been a positive conduit of information, with a council appointed director providing TCAL with a council perspective on things and also being able to provide the council with the TCAL perspective, failed.

'I wasn't able to add value to either organisation in that position,” says David.

'I was the whipping boy for both ends – I was not doing anybody any good, I'm better able to represent the swimming community by being outside of TCAL.”

He doesn't know if he will be replaced. The council is currently reviewing the council controlled organisations and how they operate – it's probably worth going through that process before any decision is made says David.

On the recent events at the Mount Hot Pools where a major leak was discovered, only after a customer persisted in his attempts to draw attention to pool temperatures, David says TCAL should listen to the community.

'I think there are a number of occasions that have arisen over the months where at the end of the day our aquatic facilities are community assets, and I think TCAL is wise to listen to those in the community and what they are saying.

'These are community facilities and community people should have their say about what's going on there and not be brushed off.”

Shame that the TCAL did not all resign and David and the Councillors took over full control of the pools like it use to be. Better pools, better maintenance and happier swimmers. TIME FOR BIG CHANGES.

The only ‘value input' is into the pockets of ‘management'. The Mount Hot Pools are used by TCC's chums TCAL to rip off the population of Tauranga! No re-investment or significant money spent since 1989 (!) because it's siphoned off (a good part to feed the bureaucracy) and now the taxpayer is expected pay for this neglect. In light of a recent ‘cinic' comment, the whole management of the Pools ought to be replaced. Quote 'It's a hole in the ground with water in it. It has a fence around it with one entrance. It has a shed to get changed in. Pool Management (not including the people who actually do the work at the pools) Cost is $750,000 last year. Admin $512K, Consultants $198K and Audit $37K. Interest paid to the council and TECT $332K. Administration services provided by the Council, $125K. It is a Council Compensates Oldboys. Over the top management and bureaucracy by the council as usual whether they are directly or indirectly involved makes no difference to the ratepayer, either way they are shafted.” These people would have no chance of employment in market-orientated business. Remember, bureaucrats, that rates come from people working hard to GENERATE wealth for the Council to extort via rates and then distribute, often to chummy entities, like the TCAL or bowling parks, where all the usual suspects like Cosby, Stewart and buddies have interests and directive in. From the TCAL minutes 28th April 2010 2. CONFLICTS OF INTEREST Frances Denz advised of her continuing membership / involvement with City Partners, Smartgrowth and Priority One. Frances Denz also declared a conflict in her capacity as a TECT director regarding the correspondence on imputation credits and the move of these to a tax group with TCIL / TCVL. IT WAS RESOLVED that Frances Denz abstains from voting or taking part in discussions where a conflict may arise. David Stewart declared his position as a Tauranga City Councillor, board member on the BOP District Health Board and Board member of Tauranga Airport Committee. IT WAS RESOLVED that David Stewart abstains from voting or taking part in discussions where a conflict may arise. Mike King advised of his ongoing involvement with SK Corp. Mike King also advised that SGL are consulting and providing advice on the Mount Hot Salt Water Pools redevelopment project, per previous resolution and Malcolm Gibb's confirmation of these arrangements. IT WAS RESOLVED that Mike King abstains from voting or taking part in discussions where a conflict may arise. The conflicts of interest register was updated. Mr King gets paid $40k plus expenses a year to recommend using his company as consultants. He boosts on his LinkedIn page that that the pools turnover is over $7 million a year and employees over 150 staff, nothing about TCAL's ongoing losses - if it good enough for David Stewart it should be good enough for Mr King.

It is all close I think you will find, not "open". There is no way that TCAL has $7m turnover (that means sales, right?). TCC pays $6.1m in a year, votes about $780,000 in for who knows what?, pays all the interest of about $2.5 million a year on some $25-30+ million of racked up debt, then there are all teh consultants (and al related costs) feeding off the massage rooms of about another $1.5 million a year for the last few years ... all that adds to about $11 million a year. To say otherwise is boulder-dash! the TRUE REVENUE OF TCAL is about $900,000 a year on a good day, there can NEVER be a profit, it is impossible if the truth is presented on it.

Its a swimming pool People Surely we as a City have the ability to manage a bloody swimming pool. How the hell did running a pool complex get so dam difficult? We split the atom but can't run the pools ...Great indictment on us all.

Conflicts of interest and secret squirrel agendas all over the damn place.Only recognises these now as and when it suits to do so.The spin doctoring reads like an exercise in electorate damage control.Deputy Mayor Stewart should never have been appointed to the TCAL Board just as Mayor Crosby should never have been appointed to the TCVL Board.The glaring stupidity with these appointments and breach of protocol is now out there for everyone to see.

TAURANGA CITY AQUATICS LIMITED (TCAL)a CCO a completely controlled council company made up of handpicked TCC board members and entirely funded by TCC in respect of any shortfalls($millions annually).So here we have Deputy Mayor Stewart the Council appointed representative on the TCAL board saying he is the whipping boy or the meat in the sandwich and can't effectively control the position.Who in their right minds would fall for that yarn.Someone want to reveal the real facts (?).Might be illuminated by the media within the next few days from stories circulating.

That is a conflicit David, that is why you are out of the room. Also as a Director of TCAL you are duty bound to make decisions that are in teh best interests of TCAL not TCC, so how can you sit in two chairs at once ? How to you wear two (or is it three?) hats at once, obvious answers here, get with the program.

Appointed himself, so one would guess that he would need to "un-appoint" himself, while he is at it perhaps he should also resign from yet another huge loss making mess the Rotorua Airport, then perhaps devote some time to trying to get it right here in Tauranga. Hmmmm that was not a good idea, chnage ... tack better he is given more jobs in Rotorua, that means less time here and less mess ups right? Much better idea. Bring on the picnic baskets!
