The Mount Protection Society's first public outing resulted in donations to its cause and about 200 signatures on a petition to stop a redevelopment of the Mount Hot Pools.
A positive response at a sausage sizzle gave the Mount Protection Society hope as it prepares for the legal wrangle with Tauranga City Aquatics Ltd.
Tauranga City Aquatics Ltd, a Tauranga City Council controlled organisation, is appealing an independent commissioner's decision to refuse planning consent for their $10 million hot pools redevelopment and expanded wellness centre plan.
The MPS formed to fight TCAL's planned redevelopment held a sausage sizzle at Mount Maunganui Main Beach on Sunday.
'A lot of people came over to see what was going on and to get some further information,” says MPS member and Tauranga City Councillor Catherine Stewart.
'Over 200 people signed a petition to council to stop the redevelopment,” says Catherine. 'It was an amazing response and I think a lot of people were upset or amazed that TCAL was opposing the council's independent commissioner's findings.
'Some didn't realise the extent of the wellness centre and were surprised by many aspects of it – 99 percent of people were totally behind us.
'One or two didn't have an opinion either way, but there is massive overwhelming support for what we are doing.
'A few gave money towards our fighting fund.”
The parties are to go to Environment Court mediation on July 18, which is the first step in the appeal process.
The appeal process has placed the Tauranga City Council in an awkward position as it is defending an appeal made by its own CCO.
The appeal is lodged against the decision to decline consent made by an independent commissioner, who was engaged in the process by the council.
In the appeal, TCAL is seeking legal costs from the city council – the ratepayers.
'I think it's a unique situation, but at the end of the day it's all part of quite a complex process of the Resource Management Act – and ultimately TCAL is seeking to improve the site,” says Mayor Stuart Crosby.
'What TCAL has asked to do is to take into account what the commissioner's said with regard to the failings of their first application and see if they can address those through negotiation, which is always the first part of an appeal.
'You don't rush straight off to court – you see if you can resolve the issues of concern.”
He expects the councillors to be consulted at every step – including if TCAL elects to take the appeal to the Environment Court, a process the city will have to pay for.
'Ultimately we pay anyway,” says Stuart.
'They are a council controlled organisation, but ultimately it is a ratepayer owned entity and I don't think we should forget that.
'You have to respect the process. You have to respect their right to appeal. And you have to respect individual people in the community's right to object to a proposal.
'And yes that costs everybody money at the end of the day, but it's called democracy.”
Commissioner Greg Hill declined the TCAL proposal because it is not appropriate for the conservation zone and public reserve land which TCAL expects to appropriate for the expanded hot pools.
The redevelopment is also not consistent with the outstanding landscape feature of Mauao.
He also expressed concerns about the adverse effect it will have on the landscape, the loss of visual amenity, loss of open space and the effects it will have on transportation and parking.
The Mount Hot Pools is closed for the next few months while a leak is repaired.

The expansion should not be undertaken because we CANNOT AFFORD it at the moment. All of the other objections are also valid, but the simple fact is that there are other priorities for $10 million of ratepayer's money. TCAL should recognize that wasting more money in a legal debate goes strongly against the grain of local public opinion and simply withdraw their proposal.

The appeal and the proposed expansion should be canned as it is not a high priority requirement for Tauranga and both are totally unneccessary. The estimated cost can be be better used by TCC in paying towards essential city projects. The TCAL CEO should be strongly reprimanded (if not removed)over her decision to proceed with a costly appeal against an independant commissioners ruling. If it does go ahead TCAL itself should be made to pay all costs with no assistance from TCC or ratepayers. I have nothing against a major refurbishment of the hot pools but an upgrade and expansion to the proposed level by TCAL is ridiculous and a complete waste of money. TCAL is obviously not "controlled" by TCC otherwise it would have stopped the appeal dead in it's tracks. The fact that the Mount Protection Society already has around 200 signatures on a petition against the development should wake both TCAL and TCC from their slumber and make them realise that they have a real fight on their hands. Let battle commence !

If TCAL is objection to the "LOST CAUSE" of the failure consent why doesn't TCC pay the objectors as well, they are actually on the same side as TCC yet TCC is paying TCAL to fight TCC but not their own supporters?? This all around the wrong way?

There are no pools it, being amended, altered in any material way. The spend up of ratepayers money is not for pools at all it is only for massage rooms and so on. The whole thing is a arrogant RORT inflicted upon ratepayers!

A failed consent in February, now millions more are being added to teh tab for an appeal, TCAL is not spending anything because they don't have money unless TCC gives it to them, what ever happens Ratepayers PAY for all of this circus.

Don't bother doing the more expensive upgrade, just stick to the works to get the area updated and the hotwater fixed. Then charge those who use the pools for it. Don't ping the ratepayer

@ Inconvenient Truth, yeah good idea that will mean that the price would be maybe 10x what it is now. I think that the wages and costs should simply be tied to how much $$$ comes in, a "normal" retail business will have about 10% of its sales as a wage cost, at TCAL it is about 350+%.

Government has taught TCC well how to end up paying the bills on both sides and of course decades later the bills are still rolling in relentlessly. Missing in action, dumped or what, the core of this spend up is a raft of massage rooms, who knows why we need them all, for a few JAFFAs that maybe will wander in to town for a week or two a year, all this scheme is mad.

Sorry to say nothing is worse than the Waitangi Tribunal it is the ultimate wrecking machine with the main componentry being general bias, racial bias, segregation,and preferential treatment.The unwavering determination to accept myth and fantasy as fact is a bit of a worry but then what goes round comes round in aces.Now TCC on the local scene is as bad as it gets to be sure and Mount Hotpools is as dodgy as it gets.
