Former Tauranga City Councillor Hayden Evans is not a fit and proper person to hold a firearms licence, the court has decided.
Hayden conducted his own case, and called Western Bay of Plenty Police Area Commander Mike Clement, Tauranga Mayor Stuart Crosby, his former girlfriend and neighbours as witnesses.

Hayden's firearms licence was surrendered in July 2009 at a time of high stress for the then city councillor. He also handed over a 7.62mm AK47 with a short magazine, two shotguns, one which was a custom-fitted clay bird gun, and an air rifle.
In evidence, Mayor Stuart Crosby said Hayden was under a lot of pressure at the city council, at home where his relationship was foundering, and economically.
Hayden's demeanour changed about that time and people around him, including councillors and members of the public, were genuinely concerned about his state of mind.
In his cross examination of witnesses, Hayden pursued answers to issues that saw Judge Robert Wolff twice interrupt proceedings saying witness cross examination was not for Hayden to carry out a public examination on issues not related to the case's central point.
The case could have been completed in a day, but was going over that because of Hayden's focus on minutia and there was an attempt to reveal conspiracy against him.
Whether or not there was a conspiracy to ensure he was harmed by the removal of his firearms licence was not a matter the court had to deal with.
The Judge was not going to allow the court to become a forum to re-debate issues of peripheral interest.
The judgement to prohibit Hayden from holding a firearms licence was made at the start of the month.
Hayden says he will appeal.

Lots of interesting points in there for sure. Fancy the Judge not allowing the "conspiracy" concept to be examined? that would have gone to the HEART of the problem, we all know TCC Councillors and of course "The leader" are rather prone to over zealously conspiring for a desired end result, even to using personal information whenever possible for self gratifying personal gain.

What a surprise that the case took longer than it should because of Hayden's focus on minutia. Just another attention getting and desperate ploy by Evans to play his life in the public arena. Get a life.

@ Earlybird, please do have another read of what was written above in the article, I merely have already done that are commented in the obvious way as a result. The Judge did not "WANT" to hear about "CONSPIRACY", with what has been in the media in the last few years as well as adopting an objective and realistic view of it all one can only wander why that subject was "AVOIDED LIKE THE PLAGUE" by the court as if it was so then it would have been VERY VERY important when considering the actions of the Mayor and others, the conclusion would then have to be viewed a lot differently than is currently the case so far, right?

... is that on two occasions (along with two others that I know of) I was served papers requiring me to attend the court, and that on both occasions was not called - time wasted, sitting in a waiting area. I wonder why that was?

Tell us all here on Sunlive what you would have said, instead of some cryptic comment. Wasn't Hayden Evans part of the team you were the leader of? Some of us have still got the election leaflets and long memories. When former Cr Evans got his drink driving conviction, what did you do about that Cr Guy? Didn't Evans also have some sort of sub contract on the Council's new sports center at Baypark? If true, was that ok by you? So let's hear the full story from you, Cr Guy, about these questions and the Evans firearms thing. Was it just councillors involved or were there other people, and if so who and why? No more cryptic comments, just the facts please Cr Guy. As far as I'm concerned I've no time for any councillor with a drink driving conviction, guns or a lot of other things I've read over the years, like being paid by ratepayers but not paying rates on time. I also don't have much time for councillors who don't give straight answers and just use innuendo and insinuation.

@ g fokks, dont hold your breath on that one, as soon as someone is being pushed out of the fold (started well before all the dramas talked about, plans were made. Actual Murray it is fair to say that actions speak loulder than words, right! That being the case then perhaps the little cosy group in the Councillor lounge that meet just before all this "HAPPENED" could provide a copy of the tape recording of that conversation (there were others of course) we will actually find on that tape that the events that subsequently occurred were well pre-planned.

Still haven't had my questions answered. SCOTT reminded me about former Cr Evans and his secret tape recording saga. Recently we've had News Of The World and the tricky way they recorded private conversations. Perhaps Evans could get a job with them. Looking back over Sunlive he appears to claim to be able have traces done on IP addresses and he seems to be handy with recorders. On a side issue I don't see why people living in this city need to keep guns.

sooner or later, those involved in getting rid of Hayden from Council and the whole gun saga will hopefully grow a conscience - for those of you who dont know what this is I suggest you refer to the dictionary...or Google the word! I would not be able to sleep at night if I behaved in this way towards any person. But whats the saying? Karma can be a bitch! I wait for Karma to kick in for those involved in the "lets get rid of Hayden,he knows too much" campaign...might just get the deck chair out and break open a bottle of bubbly...for Karma has strange and funny ways of biting people in the ass! Murray...you call yourself Haydens friend...yeah right! I saw straight through you and several others that Hayden trusted!

Whoa so it looks as though the Judge decided that conspiracy could only be classed as a matter of peripheral interest. Very interesting very brave and I would have thought a very foolish observation.Whatever the pros and cons of the case this was a political conspiracy to deal to Evans and we all know who was responsible for that. I believe that is directly related to asking the wrong questions in Council, hence the need to put the "Crosby Slayers Squad" onto him and so create the truth needed, a bit of what would be called "mob rule" and so easily defined as: Do as we say or else ....? I do have to admire is relentless desire to clear his name.

The Mayor would know that for sure, it was all a pre-planned and executed scheme to take him out, and they did! So much for democracy!
