A disillusioned Mr Whippy is claiming successful lobbying by competitors has resulted in changes to the bylaw governing that will adversely affect his business.
Last minute changes to the bylaw include extending the trading time from 30 minutes to a full hour, and permitting trading on Marine Parade between Banks Avenue and Oceanbeach Road between Boxing Day and Waitangi Day – for an hour at a time.
Even on wet winter Sundays parking on Marine Parade near Mount Drury is at a premium, says Tauranga Mr Whippy of 25 years Nicholas Wynne.
'People come to see the waves,” says Nicholas.
'I have drawn up a notice to my customers, ‘let me know when you are going to leave, as I would appreciate your car park'.”
Nicholas says the bylaw worked well as it was. The complaints that resulted in the review were the result of the council's own blunders in administering it last summer.
Many of the submissions bringing about the changes came from shop owners under the towers, says Nicholas - commercial interests who were not supposed to be taken into consideration.
There are six tendered car parks at the Main Beach end where traders can continue trading all day over the peak summer period between Boxing Day and Waitangi Day.
In Pilot Bay traders have to stay on the seaward side of The Mall and they are no longer permitted to gang up on cruise ship passengers by infesting the car park by the port gates.
