No prosecution for Boobs on Bikes

Tauranga City Councillors have decided against prosecuting the Boobs on Bikes organisers for defying its decision to deny a parade permit.

While the council has decided not to prosecute, it is considering changing its rules to prevent future parades.

Staff are reviewing section 17 of the Street Use and Public Places Bylaw.

The event, which attracted about 3000 spectators, went ahead on August 4, two days after councillors directed staff to deny front man Steve Crow the parade permit which council staff had recommended.

Councillors said they opposed Boobs on Bikes on the grounds that there was no traffic management plan – and that it was likely to be offensive.

The decision was ignored by Steve Crow who has a High Court judgement in his favour. When the Auckland City Council tried a similar tactic the judge said it is not offensive for women to ride topless.

At the time his view was supported by councillor and former barrister Wayne Moultrie who said traffic management was the only issue open to the council.

The advice from council staff at the time was that 10-25 bikes riding through town did not require a traffic management plan.

Boobs on Bikes organisers had applied for a permit and council staff were discussing traffic management issues with organisers when the politicians made their decision.

A glimmer of hope among the gloom

FINALLY! The councillors have made a sensible decision, albeit under a hail of bullets from their constituents. However it would still appear they don't really get it if they are considering changing the bylaw. When will they understand that Steve Crow is only after publicity? Nothing gives a bloke like him more coverage than a battle over regulations, accusations of moralist councils, and controversy. He won't waste his advertising budget trying to promote his Auckland event anywhere where nobody gives a damn and the turnout is poor. He will spend it wherever he thinks he will get the best bang for his buck (no puns intended). If you ignore the show-offs in this world they will seek a new audience elsewhere.

Yeah right.....

Changing any bylaw will have some rather interesting side effects. Like existing unpermitted processions after a tangi being ruled illegal.
